DECREE OF THE MINISTER OF TRADE AND INDUSTRY

CONCERNING
APPOINTMENT OF SURVEYORS TO IMPLEMENT VERIFICATION OR TECHNICAL INSPECTION
INTO THE IMPORT OF RICE, SKINNED RICE SUITABLE FOR SEEDLING (SEEDS), GLUTINOUS RICE (PULUT), RICE FLOUR, AND OTHER FLOURS

THE MINISTER OF TRADE AND INDUSTRY OF THE REPUBLIC OF INDONESIA,

Considering:

• a. that, in the framework of enforcement of Article 12 of Decree of the Minister of Trade and Industry No. 9/MPP/Kep/1/2004 on Rice Import, it is necessary to appoint surveyors to conduct verification or technical inspection into the import of rice;
• b. that, for that purpose, a Decree of the Minister of Trade and Industry need to be issued.

In view of:

Decree of the Minister of Trade and Industry No. 9/MPP/Kep/1/2004 on Rice Import.

DECIDES:

To stipulate:

FIRST:

Appointing the following parties as surveyors:

• 1. PT (Persero) Sucofindo;
• 2. PT (Persero) Surveyor Indonesia;

to implement verification or technical inspection into the import of rice, skinned rice suitable for seedling (seeds), glutinous rice (pulut), rice flour, and other flours.

SECOND:

Both of the surveyors, as specified in the FIRST dictum shall have duties:

• 1. To perform verification or technical inspection into data or information regarding:
• a. Country of loading;
• b. Specifications including H.S. Number and description;
• c. Quantity and type;
• d. Shipment time; and e. Port of destination.
• 2. To write down results of the verification or technical inspection, as set forth in paragraph 1, in a Surveyor's Report, which is used as an import manifest;
• 3. To submit a written report regarding the verification or technical inspection into the import of rice, skinned rice suitable for seedling (seeds), glutinous rice (pulut), rice flour, and other flours, periodically (every month: in the first week of the following month) to the Director General for Foreign Commerce c.q. the Director of Import of the Department of Trade and Industry.

THIRD:

Delay or failure in the issuance of the Surveyor's Report due to surveyor's failure, either intentionally or not, shall be borne by the surveyor in accordance with the regulations applicable within the International Federation spection Agency/IFIA).

FOURTH:

In conducting verification or technical inspection into the import of rice, skinned rice suitable for seedling (seeds), glutinous rice (pulut), rice flour, and other flours, the surveyors may collect a fee for their rendered services from importer, which amount will be suited to the benefit enjoyed.

FIFTH:

All expenses incurred in relation to this Decree shall be borne by the surveyors.

SIXTH:

The appointment of surveyors, as set forth in the FIRST dictum, shall not eliminate the authority of the Minister of Trade and Industry to withdraw, replace, and add other surveyors for the implementation of verification or technical inspection into the import of rice, skinned rice suitable for seedling (seeds), glutinous rice (pulut), rice flour, and other flours.

SEVENTH:

Technical rules with regard to the enforcement of this Decree will be stipulated in a Decision of the Director General for Foreign Commerce of the Department of Trade and Industry.

EIGHTH:

This Decree shall come into effect from the date of stipulation.
